These Terms of Use (“Terms”) apply to the MetalFolio mobile application (the “App”) and the website at metalfolio.app. By downloading, installing or using the App, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the App.
These Terms supplement Apple’s Licensed Application End User License Agreement (“Standard EULA”). If they conflict, the Standard EULA applies to the extent required.
1. The App
MetalFolio provides market prices for precious metals, currencies and cryptocurrencies, along with tools such as portfolio tracking, price alerts, charts and calculators. We may change, add or remove features, or suspend or discontinue the App, at any time.
2. Not investment advice
All prices, charts, calculations, notifications and other content in the App are provided for general information only. They are not financial, investment, tax or legal advice, and they are not an offer or recommendation to buy or sell any asset.
Prices are market reference prices and can differ from the prices offered by dealers, banks or exchanges, which may include premiums, spreads, fees and taxes. You are solely responsible for your investment decisions. Markets involve risk, and past performance does not guarantee future results.
3. Market data and alerts
Market data comes from third-party sources and may be delayed, interrupted, incomplete or inaccurate. Update frequency depends on your plan. Price alerts and push notifications depend on your device, network, operating system settings and third-party services; they may be delayed or not delivered and must not be relied on as your only source of information.
4. No account and your data
The App does not require registration. Your portfolio data is stored on your device, so you are responsible for keeping it — for example, it may be lost if you delete the App or change devices. See the Privacy Policy for how information is processed.
5. MetalFolio Pro subscriptions
- MetalFolio Pro is an optional, auto-renewing subscription purchased through your Apple ID. Prices and billing periods are shown in the App before you purchase.
- Payment is charged to your Apple ID at confirmation of purchase. The subscription renews automatically unless it is cancelled at least 24 hours before the end of the current period, and your account is charged for renewal within 24 hours before the period ends.
- If a free trial is offered, any unused portion of the trial is forfeited when you purchase a subscription. If you do not cancel before the trial ends, the subscription starts and you are charged.
- You can manage or cancel your subscription in your iPhone or iPad Settings → your name → Subscriptions. Deleting the App does not cancel a subscription.
- Payments and refunds are handled by Apple under its terms. Refund requests can be made through reportaproblem.apple.com.
6. Advertising
The free version of the App displays third-party advertising. Some features may require watching an ad. We are not responsible for the content of advertisements or for products and services offered by advertisers.
7. Acceptable use
You agree not to:
- copy, modify, reverse engineer or decompile the App, except as permitted by law;
- extract, scrape or redistribute the App’s market data or content, or use it in a commercial service;
- interfere with, overload or attempt to gain unauthorized access to the App, its servers or related services;
- use the App in violation of any applicable law.
8. Intellectual property
The App, its design, text, graphics and software are owned by MetalFolio or its licensors and are licensed — not sold — to you for personal, non-commercial use under these Terms and the Standard EULA. Third-party names and trademarks belong to their respective owners.
9. Third-party services
The App relies on third-party services such as Apple, market data providers, analytics, notification and advertising providers, and may link to third-party websites. We are not responsible for their content, availability or practices.
10. Disclaimer of warranties
To the fullest extent permitted by law, the App is provided “as is” and “as available”, without warranties of any kind, express or implied, including warranties of accuracy, merchantability, fitness for a particular purpose and non-infringement. We do not guarantee that the App will be uninterrupted or error-free.
11. Limitation of liability
To the fullest extent permitted by law, MetalFolio will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, investment losses, loss of data or trading losses, arising from your use of or inability to use the App, even if advised of the possibility of such damages. Nothing in these Terms limits liability that cannot be limited under applicable law, including your statutory rights as a consumer.
12. Changes to these Terms
We may update these Terms from time to time. The updated version will be posted on this page with a new date. Continuing to use the App after changes take effect means you accept the updated Terms.
